1 - Introduction

ABSOLUTEPIXEL UNIPESSOAL, LDA (hereinafter Kapta) wants you to be familiar with how your data is collected, used and disclosed to third parties, as your privacy and its protection are essential to maintaining a relationship of trust.

The Privacy Policy followed by Kapta complies with the General Data Protection Regulation (RGPD in Portuguese, or GDPR), a European regulation (EU 2016/679) that establishes new rules on the protection, processing and free movement of individuals’ personal data in European Union countries. From 25 May 2018, this regulation replaces the Data Protection Law — Law No. 67/98 of 26 October.

This Policy describes the type of personal data collected, how it is used and with whom it is shared. It also describes Kapta’s general practices for handling Other Information (for example, interests, demographic data and use of services) collected through monitoring and analytics tools. We also describe the measures we take to protect information, your choices and access options, and how you can contact us about privacy practices.

All personal information collected about you will be used to help make your visit to our website as productive and enjoyable as possible. Ensuring the confidentiality of our website users’ personal data is important to Kapta.

Use of the Kapta website presupposes acceptance of this privacy agreement. We may change this agreement without prior notice. We therefore recommend that you consult our privacy policy regularly so that you are always up to date.

2 - Definitions

2.1. “Personal Information” is data relating to an identified or identifiable individual, such as:

  • Telephone number (including landline and mobile telephone numbers);
  • Email address;
  • Profile picture;
  • Social media nickname (e.g. Facebook username);
  • Location information, if that information is linked to an identifiable individual;
  • Personal traits;
  • Browsing and consumption habits, preferences, likes and interests.

An identifiable individual is an individual who can be identified, directly or indirectly, by reference in particular to an identification number or to one or more factors specific to their physical, psychological, mental, economic, cultural or social identity.

2.2. “Specially Protected Data” is personal information considered particularly sensitive, such as:

  • Racial or ethnic origin;
  • Ideology or political opinions;
  • Religion or other beliefs;
  • Health or illness;
  • Legal history;
  • Trade union membership;
  • Sexual orientation.

We ask that you do not provide or disclose specially protected data to us through our Website, our Social Media or by any other means. However, if you communicate any data of this nature to us, you will be consenting to and authorising, under your sole responsibility, our storage and processing of it in our files for the purposes stated in this policy or those you specify when communicating that data.

2.3. “Other Information” includes, for example:

Browser and device information;

Information gathered through cookies, pixel tags or other technologies, provided that subsequent identification of the user is excluded;

Demographic and geolocation information.

2.4. Other people’s personal information:

You must not send us or publish other people’s Personal Information on our Website, Social Media or through other channels, e.g. email. If you wish to submit information about third parties, you must ensure that this information is submitted directly by the person or persons concerned, regardless of the means of contact used (Website, Social Media or other channels). If, despite this warning, you send us another person’s Personal Information by publishing it on our Website, Social Media or through other channels, we will assume, under your sole responsibility, that you have their prior authorisation and explicit consent to do so, including authorisation for us to use that Personal Information as described in this Privacy Policy.

3 - Information We Collect

Kapta undertakes to process only the personal data strictly necessary to improve your experience of using our website.

3.1. Personal Data

For the purposes of this Privacy Policy, Personal Data is information that identifies you as an individual or relates to an identifiable individual.

3.1.1 Personal Data submitted by the user:

We collect Personal Data when it is submitted directly on our website, such as when a job application is registered on the page we have dedicated to that purpose, or when you submit a general contact form. The personal data submitted may include your name, address, telephone number, email address, date of birth, country of residence, city/location, nationality, qualifications, professional experience; current employment status. Proficiency level according to the Common European Framework of Reference for Languages, educational institutions attended, courses attended, their completion dates and the grades obtained.

3.2. Other Information

Other Information is any information that is not intended to reveal your specific identity to us, such as browser information, usage data, information collected through cookies and other technologies, demographic information and geolocation data obtained with your consent, where required by applicable law.

3.3 Information collected automatically

The website only uses analytics and marketing cookies and other non-essential monitoring technologies after your express consent in the cookie manager. Before that consent, Google Analytics, Meta Pixel and embedded YouTube videos are not loaded. Please see our information about cookies below.

Regarding the privacy policy for cookies and external monitoring tools, Kapta is not responsible for the privacy practices of those third parties. To stay informed, we advise you to consult the privacy policy of each applicable third party.

4. How we use your personal data, other information and information collected automatically.

Kapta guarantees that your personal data is processed only for the purposes communicated to you and is not used for any other purpose. We therefore process your personal data to ensure the quality of the service we provide to you and to enable us to better respond to your needs.

4.1. Measure and improve our products and services

All personal information collected about you will be used to help make your visit to our website as productive and enjoyable as possible, including: processing a job application; processing a contact request; measuring interactions with specific website pages; providing customer support; improving our website’s interface so that browsing it is intuitive and satisfying.

4.2. Improve the website’s content

To make your experience more interesting and personalised, we may use any of the Personal Data and Other Information collected so that the website’s content reflects its users’ preferences, for example by presenting posts on our blog with content relevant to visitors, taking into account their browsing habits on the website.

On our website, you can interact with us in various ways, by email, contact form or application. We may also use your information (including a telephone number and email address you have provided for that purpose) to contact you to respond to your comments, enquiries or requests.

4.4. To safeguard your rights and Kapta’s rights

Under the data protection legislation in force in the European Union (the General Data Protection Regulation), the use of personal data must be justified on at least one legal basis for processing personal data. You can consult the explanation of the scope of each of these bases. *

The legal basis applicable to the collection and use of your personal data for customer support and marketing purposes is your consent.

5. How we keep your personal data secure

We use a variety of security measures, including encryption and authentication tools, to help protect and maintain the security, integrity and availability of your personal data.

Although the transmission of data over the internet or a website cannot guarantee complete security against intrusions, we and our service providers and business partners make every effort to implement and maintain physical, electronic and procedural security measures designed to protect your personal data in accordance with applicable data protection requirements. Among others, we have implemented the following:

Restricted staff access to your personal data on a “need-to-know” basis and only within the scope of the purposes communicated;

Transfer of collected data only in encrypted form;

Storage of highly confidential data (such as credit card information) only in encrypted form;

5. Cookies and similar technologies

We use the website’s consent manager to display the consent interface and save your preferences. Cookies that are strictly necessary for the website to function and to record those preferences do not require consent. The remaining services are only loaded after you accept the relevant category.

5.1 Statistics

With consent, Google Analytics is used to measure use of the website and improve its content and services.

5.2 Marketing and third-party content

With consent, Meta Pixel may be used to measure marketing campaigns. Embedded YouTube videos are only loaded after you accept this category, as they may allow the respective provider to collect technical usage data.

5.3 Managing preferences

You can accept, refuse or change your preferences at any time, without affecting the lawfulness of processing carried out before consent was withdrawn.

6. How long we retain your personal data

We retain your data only for as long as is necessary for the purpose for which it was collected.

Once the maximum retention period has been reached, your personal data will be irreversibly anonymised (and the anonymised data may be retained) or securely destroyed.

For the purposes described in this Privacy Policy (customer support), your personal data will be retained for a maximum period of 5 years from the date your consent was obtained or the last contact made (whichever occurs later), provided that you have not withdrawn your consent within that period. For matters relating to Marketing, we will keep your contact details until you unsubscribe or indicate by other means your wish not to remain with us.

7. How you can change or withdraw your consent

You can change or withdraw your consent at any time, with effect for the future. To change your cookie preferences, use the “Manage cookie preferences” button above.

After you have fully withdrawn your declarations of consent, you will no longer be contacted or receive communications for the purposes described in this Privacy Policy.

  • erase personal data whose use is no longer lawful;
  • restrict how we use your personal data until the complaint submitted has been investigated.

Your exercise of these rights is subject to certain exceptions intended to safeguard the public interest (prevention or detection of crime) or our interest (maintaining professional secrecy).

8. Data Retention Periods

Personal data will be retained only for the period necessary for the purposes for which it was collected or subsequently processed, with compliance with all applicable legal rules on archiving being guaranteed.
